All terms and conditions are within the rules of The Consumer Contracts Regulations, by purchasing with Funkypinks the Buyer is agreeing to abide by these terms; by placing an order with FunkyPinks, the Buyer is accepting these terms and understands the circumstances outlined below.
Please feel free to print these terms and conditions for future reference.
"Business days" refers to any working day recognised by local government. It doesn't include; weekends, bank holidays, or public holidays (dependant upon shipping location), Christmas Day, New Year’s Day, Thanksgiving (USA only) or Easter Sunday.
“Buyer” refers to the customer placing an order with FunkyPinks.
“Custom Request” refers to an item or design that is not currently listed on the FunkyPinks website.
“Dispatch” refers to a completed order packed ready for shipping.
“Item” refers to an individual piece of jewellery.
“Priority Shipping” refers to a faster shipping option offered by FunkyPinks.
“Processing days/time” refers to the time taken to make, pack and dispatch an order.
“Order” refers to the total number items purchased,
“Shipping or Shipped” refers to an order taken to a Post Office in the UK.
1. Placing an Order
1.2 All items on the FunkyPinks website are made to order, unless otherwise stated, therefore all orders received through the website are processed on a strict first come, first served basis.
1.3 Processing times may vary due to high demand, current processing and estimated shipping times are provided on the website here.
1.3 Orders will only be prioritised if purchased with Priority Shipping.
1.4 If Priority Shipping is selected as the shipping method at the checkout, orders will be prioritised and processed before orders that have been purchased with standard shipping.
1.5 If the buyer places an order and wishes to make an amendment (such as initial or colour) – they must send an email to email@example.com to ask for an amendment. Orders can be amended if this request is received before processing has been completed.
1.6 Any amendments to an order may be subject to additional cost, if the amendment requires different materials. This will be advised upon acknowledgement.
2. Custom Orders and Requests
2.1 If the Buyer would like to order a custom item, they should use the form on the Contact Page, or send an email to firstname.lastname@example.org with the request including: Type of item (necklace/bracelet/earrings etc), number of items required, when the Buyer would need these items to be delivered and any additional information.
2.2 The request will be reviewed within 24 hours, and an initial quotation will be provided along with timescales for processing and shipping.
2.3 Payment is requested upfront to cover initial costs of any materials not currently held in stock.
2.4 FunkyPinks reserves the right to change the initial quotation for any unanticipated circumstances; including but not limited to; additional time taken to adjust the item to the Buyers specifications; multiple adjustments; any adjustments considered ‘major’ or any additional materials required to complete the order. These may be subject to additional costs.
2.5 Custom requests will not be processed or shipped until full payment has been received from the Buyer.
2.6 Once final payment is received, orders will be shipped out within agreed or stated timescales.
2.7 Custom requests are processed alongside regular orders (first come, first served) unless purchased with Priority Shipping, or agreed as part of the quotation process.
2.8 FunkyPinks may on occasion be unable to accommodate custom requests, this will be advised during the quotation period.
3.1 Payment through the FunkyPinks website use a PayPal payment gateway. Buyers can purchase through this gateway using a debit or credit card, or by using their own PayPal Account.
3.2 Buyers do not need an account with PayPal in order to purchase through the gateway.
4.1 All orders are shipped from the UK using Royal Mail.
4.2 The Buyer will receive an email when the order has been shipped.
4.3.1 UK RESIDENTS: Please allow 14 business days from the date items are shipped for delivery.
4.3.2 If the Buyer have not received the order after 14 business days, they should contact email@example.com for assistance.
4.3.3 NON UK RESIDENTS: Please allow 20 business days from the date items are shipped for delivery.
4.3.3 If the Buyer have not received the order after 20 business days, they should contact firstname.lastname@example.org for assistance.
4.3.4 All orders shipping overseas are sent using a tracked service, and a tracking number will be provided approximately 2-3 days after shipping.
4.4 If an order is lost in transit, the Buyer will be asked to wait the stated times above for delivery. If an order hasn’t arrived after these stated times, the Buyer will be entitled to a replacement at no extra cost, or a full refund.
4.5 Buyers are responsible for providing the correct shipping address at the checkout, and confirming that it is correct.
4.6 FunkyPinks accepts no liability for orders shipped to an incorrect address provided by the Buyer, and the Buyer would not be entitled to a refund or a free replacement.
4.7 If the Buyer notices they have provided an incorrect shipping address before the order has been shipped, then the Buyer is able to cancel their original order, and re-order the same item and providing the correct shipping address.
4.8 If an item is returned to sender due to an incorrect shipping address, the Buyer would be required to pay for return shipping again, if required.
5.1 Most items are shipped in a small gift box unless otherwise stated, please check each listing for details of packaging.
5.2 Personlised gift boxes are sold separately, and the Buyer may not be sent a 'proof' in advance of shipping.
5.2.1 Messages for personalised gift boxes are printed exactly how the Buyer requests in a message or email. FunkyPinks accepts no liability for mistakes made by the Buyer.
5.2.2 If the Buyer does make a mistake, they would be required to pay an additional fee, negotiable depending on circumstance, in order to replace the card insert.
5.2.3 If FunkyPinks makes a mistake, the card insert will be replaced.
5.2.4 The Buyer would not recieve an additional box if a mistake is made on the card insert.
6. Returns and Cancellations
6.1 If the Buyer has any problems at all, please contact email@example.com as soon as possible.
6.2 Returning Earrings For hygiene reasons, earrings cannot be returned under any circumstance. A refund or replacement may be provided if the earrings arrived damaged, this must be reported within 24 hours of reciept of order, and photographic evidence must be provided.
6.3 Damaged or Faulty Items If any jewellery (other than earrings) are damaged during shipping, or outside of reasonable wear and tear, the Buyer will be offered a replacement, or a full refund.
6.3.1 Faulty or damaged items must be reported to FunkyPinks within 24 hours of receipt of order and photographic evidence must be provided.
6.3.2 If the Buyer requests a replacement for a faulty item, these items will be shipped out within 2 business days upon reciept of photographic evidence. Where possible, a pre-paid return envelope will be provided to the Buyer to return the faulty item.
6.3.3 If the Buyer requests a full refund due to a faulty item, the Buyer will be asked to pay the initial return shipping cost and a full refund would be processed within 3 business days after the item has been recieved back, including the cost of return shipping.
6.3.4 FunkyPinks reserves the right to refuse any refund or replacement without photographic evidence or if there is evidence of mishandling.
6.3.5 An item may not be returned as faulty if it has been worn for more than a period of 3 months, this would be defined as reasonable wear and tear.
6.4 Incorrect Items If any jewellery (other than earrings) are made to incorrect specifications, the Buyer will be offered a replacement or a full refund.
6.4.1 An incorrect item would be defined as an incorrect initial, colour, size or charm.
6.4.2 Incorrect items must be reported to FunkyPinks within 24 hours of receipt of order and photographic evidence must be provided.
6.4.3 If the Buyer requests a replacement for an incorrect item, these items will be shipped out within 2 business days upon reciept of photographic evidence. Where possible, a pre-paid return envelope will be provided to the Buyer to return the incorrect item.
6.4.4 If the Buyer requests a full refund due to a incorrect item, FunkyPinks will process a full refund within 3 business days upon reciept of photographic evidence. Where possible, a pre-paid return envelope will be provided to the Buyer to return the faulty item.
6.4.5 FunkyPinks reserves the right to refuse any refund or replacement without photographic evidence, of if the jewellery has been worn, or if there is evidence of mishandling.
6.5 General Returns The Buyer may return an order for a full refund if they change their mind and the items are not damaged or faulty if i) the jewellery hasn't already been worn or damaged and ii) it is received back in its original packaging. within 14 days (UK) or 20 days (Non-UK). The Buyer is expected to pay for return postage, and original postage would not be refunded.
6.6 If the Buyer is returning an order for any reason, they will be instructed to use a tracked shipping method. FunkyPinks will not be responsible for returned items being lost in the post without tracked proof of shipping.
6.7 Orders should be returned to: FunkyPinks Jewellery, 32 Perryfields Crescent, Bromsgrove, B61 8SS.
6.9 Personlaised Hand stamped Jewellery are custom made/personlaised items and FunkyPinks may not be able to be re-sell the items if they are returned. Therefore some of these items may be exempt from this returns policy.
6.10 Cancellations Orders may be cancelled if they have not been shipped, please see this page for current processing times.
6.10.1 All cancellation requests must be emailed to firstname.lastname@example.org as soon as possible.
6.10.2 If an item has been shipped, the buyer will be able to return the items in line with clause 6.5.
7.1 Should the Buyer wish to submit a complaint, please send an email to email@example.com or a written letter to: FunkyPinks Jewellery, 32 Perryfields Crescent, Bromsgrove, B61 8SS.
7.2 All complaints will be acknowledged within 48 hours.
7.3 All complaints will handled in a timely, courteous and professional manner.
8. Other General Terms
8.1 All prices are subject to change at any time. FunkyPinks reserves the right to cancel and refund any orders that are a result of a pricing glitch or error.
8.2 All items are made to order, online images are samples of products and therefore items received may differ slightly to the one pictured.
8.3 All items are made using the same materials as pictured on the listings, or the closest suitable alternative if the same materials are not available.
8.3 The item you receive may vary slightly in colour due to the screen settings on your PC or mobile device.
8.4 All offers will have a clearly displayed expiry date - This will be stated in the offer description.
9.5 FunkyPinks may close for vacation or during times of high demand. If the shop is closed this will clearly be displayed on the website with an estimation of when the shop will be re-opened. No further orders may be placed when the shop is closed and all orders recieved before the shop has closed will be processed within the times stated on the 'Processing Times' page.
8.6 Personalised stamped jewellery pieces that are stamped by hand, not engraved, this means there will be variation from piece to piece, text may not be perfectly straight. This adds to the unique and individual charm of each item, and is not considered to be a defect.
9.1 FunkyPinks does not store any customer card details.
9.2 Any purchase through the FunkyPinks website may enlist the Buyers email address to the FunkyPinks monthly mailing list.
9.2 Any email information will be held securely and will not be shared with any third party or affilliate.
9.3 Buyers can unsubscribe to the mailing list at any time by clicking the 'unsubscribe' link at the bottom of the email, or by sending an email to: firstname.lastname@example.org.
